Release of Liability, Payment Terms, and Club Policies (2025)

Jay Swim & Fitness Club is committed to providing a safe, hygienic, and enjoyable environment for all users. The following guidelines and policies are designed to ensure the effective operation of our facilities and services. By using our facilities, you agree to abide by these terms and conditions.

Release of Liability

1. Conduct

All users must behave responsibly and follow instructions from authorized staff at all times. Improper conduct will result in removal and may lead to a ban.

Examples of Improper Conduct:

  • Running near the pool area.
  • Playing dangerous games or engaging in unsafe behavior (e.g., pushing others, diving recklessly, holding others underwater).
  • Non-compliance with staff instructions.
  • Bringing sharp objects or unauthorized items into the premises.
  • Disrespectful, threatening, or indecent behavior.

2. Facility Use

Facilities must only be used for their intended purposes. Users are responsible for their personal safety and the safety of others. The club is not liable for injuries, theft, accidents, or damages caused by users or third parties.

3. Damage Liability

Any user who damages club property will be held responsible for the cost of repairs or replacements.

4. Lifeguards and Supervisors

While lifeguards and supervisors are present, users remain responsible for adhering to all safety protocols.

5. Supervised Swimming

Swimmers must always be supervised by authorized personnel. Unsupervised swimming is strictly prohibited.

6. Flotation Devices

Non-swimmers are required to wear approved flotation devices.

7. Medical Disclosure

Users must inform management of any pre-existing medical conditions that may impact their safety.

8. Skin Conditions

Individuals with skin conditions must present a doctor's certificate confirming there is no risk to others.

9. Open Wounds

Users with open wounds may be denied access to the pool for safety and hygiene reasons.

10. Swimwear

Proper swimwear is mandatory for all users, along with bathing caps when in the pool.

11. Inflatables

Use of inflatables requires prior permission.

12. Food, Drinks, & Pets

Food, drinks, gum, and pets are not permitted within the pool area.

13. Health Restrictions

Sick children are not allowed to attend lessons.

Payment Terms

1. Advance Payment

Lesson fees must be paid in advance on the 1st day of the term for the agreed number of sessions.

2. Registration Fee

A one-time registration fee of GHc 100 is required for each swimmer.

3. Unused Lessons

Unused lessons are forfeited after one month.

4. Payment Methods

Payments can be made via cash, MOMO, or bank transfer.

5. Slot Confirmation

Lesson slots are confirmed upon receipt of full payment.

Club Policies

1. Policy Modifications

The club reserves the right to update or modify policies at any time.

2. Membership Rules

All members and visitors must follow club rules. Memberships may be canceled for violations.

3. Liability

The club is not responsible for injuries, deaths, or loss/damage of personal belongings.

4. Medical Disclosure

Members must inform the club of any medical conditions.

5. Contact Updates

Members must keep their contact information updated.

6. Non-transferable Use

Pool use is limited to members and paying guests only.

Absence, Refunds, and Make-up Policy

1. No Refunds

Fees are non-refundable.

2. Make-up Lessons

Two make-up lessons per swimmer per term are allowed with 48 hours' prior notice.

3. Discretionary Credits

Credits may be granted at the club's discretion for extended illness or injury.

4. Weather Cancellations

Make-up lessons or credits may be offered for cancellations due to adverse weather.

Additional Information

1. Multiple Swimmer Discount

A 5% discount is available for families with more than two swimmers.

2. Class Timeliness

  • Arrive 15 minutes early for lessons.
  • Late arrivals exceeding 15 minutes will not be admitted.

3. Instructors

All instructors are certified by World Aquatics and the Swim Teacher Association (STA). They are trained in First Aid and CPR.

4. Progress Reports

Feedback is provided after each lesson. Long-term improvement will be monitored over time.

5. Pool Deck Access

Only participants are allowed on the pool deck. Spectators must remain in designated seating areas.

6. Private Events

The facility may be booked for private events, which could result in disruptions. Free make-up lessons will be scheduled if lessons are canceled.

7. Non-solicitation

Members and guests may not solicit club staff for private services.

8. Legal Action

Issues such as non-payment or violations may result in legal action.

9. Referrals

Members who refer friends or family will receive a free class credit.
